1. Agreement to Terms

By accessing or using the Service, you confirm your agreement to be bound by these Terms. These Terms affect your legal rights and obligations. If you do not agree to be bound by all of these Terms, do not access or use the Service.

2. User Accounts

• Account Creation: To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information (your mobile phone number) during the registration process.
• Eligibility and Age Requirement: You must be at least 13 years of age to create an account and use this Service. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By creating an account, you represent and warrant that you are either of legal age to form a binding contract with the KCA or you have your parent’s or guardian’s permission to use the Service, and your parent or guardian has read and agreed to these Terms on your behalf.
• Account Responsibility: You are responsible for safeguarding the password or OTP mechanism used to access the Service and for any activities or actions under your account. You agree not to disclose your password or grant access to your account to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Intellectual Property Rights

The Service and its entire contents, features, and functionality—including but not limited to all information, software, code, text, displays, images, video, audio, and the design, selection, and arrangement thereof, as well as all team names, player profiles, logos, and trademarks—are owned by the Kerala Cricket Association, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. These Terms do not grant you any right, title, or interest in the Service or any of its content.

4. License to Use the Application

Subject to your compliance with these Terms, KCA grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on mobile devices that you own or control, solely for your personal, non-commercial use.

5. Prohibited Conduct

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. As a condition of your use of the Service, you warrant that you will not:

• Copy, modify, distribute, sell, or lease any part of our Service or its underlying software.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
• Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party’s use of the Service.
• Introduce any viruses, trojan horses, worms, or other material that is malicious or technologically harmful.
• Use the Service to engage in any activity that is defamatory, obscene, offensive, violent, or hateful, in line with app store content policies.
• Infringe upon the intellectual property rights of KCA or any third party.
• Impersonate or attempt to impersonate KCA, a KCA employee, another user, or any other person or entity.

6. Loyalty Points Program

The Service includes a Loyalty Points Program (“Program”). Your participation in this Program is subject to the following rules, which form a part of these Terms:

• Earning Points: Points may be earned by scanning valid, unique QR codes from official KCA event tickets using the QR scanner feature within the Service.
• Validation: KCA reserves the right, in its sole discretion, to validate any QR code scan and to deny points for codes that are determined to be invalid, fraudulent, or previously used.
• No Cash Value: Loyalty points are promotional, have no cash value, and cannot be redeemed for cash, sold, or transferred. They are not your property.
• Program Modification: KCA reserves the right to modify, suspend, or terminate the Program, or any part thereof, including the rules for earning points and the availability of any rewards, at any time and in its sole discretion, with or without notice to you.
• Rewards: Any rewards, discounts, or benefits offered in exchange for points will be subject to their own specific terms, conditions, and availability.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, in our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.

You may terminate your account at any time by using the in-app account deletion feature. Upon termination, your right to use the Service will cease immediately.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KCA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KCA MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.²⁰

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE KERALA CRICKET ASSOCIATION, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; OR (III) ANY BUGS, VIRUSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY.²⁰

10. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the competent courts located in Thiruvananthapuram, Kerala, India.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice within the App prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
